General Terms and Conditions
This English version is provided as a convenience translation. In case of any discrepancy, the German version (www.rocksnake.de/agb) prevails.
1. Scope and General Provisions
(1) These General Terms and Conditions (“T&C”) apply to all contracts for the supply of goods and the provision of services by ROCKSNAKE GmbH (hereinafter: “ROCKSNAKE”) to consumers (Sec. 13 German Civil Code, BGB) and to businesses (Sec. 14 BGB).
(2) A consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed predominantly to their commercial or self-employed professional activity.
(3) A business is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or self-employed professional activity when entering into a legal transaction.
(4) Deviating or supplementary terms of businesses only become part of the contract if ROCKSNAKE expressly agrees to them in writing.

E-mail: office@rocksnake.com
4. Conclusion of Contract
(1) The presentation of products in the online shop, in catalogues or in quotations does not constitute a legally binding offer but a non-binding invitation to place an order.
(2) By submitting an order, the customer makes a binding offer to purchase the selected products.
(3) The contract is concluded only when ROCKSNAKE declares acceptance (e.g. by a digital order confirmation by e-mail or by delivery of the goods).
(4) Ordering process in the online shop: The customer places the desired products in the shopping cart, enters their address details in the course of the process and selects the shipping and payment method. Before submitting the order, the customer can review all entries and correct them using the steps of the ordering process or the back function of their browser. By clicking the button that completes the order, the customer submits their binding offer pursuant to paragraph 2.
(5) We store the contract text. We send the order data to the customer by e-mail. The customer can access and print these T&C at any time on this page. Customers with a customer account can also find their orders in their account.
(6) The contract language is German. For customers who communicate with us in English, this English version is provided as a convenience translation; in case of doubt the German version prevails.
5. Right of Withdrawal for Consumers (B2C)
Withdrawal Instructions
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last of the goods.
To exercise your right of withdrawal, you must inform us (ROCKSNAKE GmbH, Steinbachergasse 15, 82487 Oberammergau, Germany, phone: +49 8822 82407-01, e-mail: office@rocksnake.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but this is not mandatory.
You can also exercise your right of withdrawal online at www.rocksnake.de/widerruf. If you use this online function, we will immediately send you confirmation of receipt on a durable medium (e.g. by e-mail), stating the content of the withdrawal declaration and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees because of this reimbursement.
We may refuse reimbursement until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is the earlier.
You must send back or hand over the goods to us (ROCKSNAKE GmbH, Logistics, Rottenbucher Str. 9, 82497 Unterammergau, Germany) without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion of the right of withdrawal
The right of withdrawal does not apply to goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive (e.g. custom-made or personalised rescue backpack systems or Velcro labels).

6. Returns and Cancellation for Business Customers (B2B)
Businesses (Sec. 14 BGB) have no statutory right of withdrawal or return. Cancellations or voluntary returns by business customers require the prior written consent of ROCKSNAKE. In the case of an approved return, the business bears all transport and return shipping costs.
7. Prices, Shipping and Minimum Order Surcharge
(1) For consumers, all prices include statutory value added tax. For businesses, prices are net prices plus statutory value added tax.
(2) Additional shipping costs as well as surcharges for bulky goods, dangerous goods (e.g. pressurised gas cylinders) or pallet shipments are shown transparently in the ordering process.
(3) For B2B orders with a net goods value below EUR 250, ROCKSNAKE reserves the right to charge a minimum order surcharge.
8. Payment Terms and Purchase on Invoice
(1) The payment methods displayed in the ordering process are available. There is no entitlement to a particular payment method.
(2) Purchase on invoice: Delivery on invoice is only possible for corporate customers / businesses (Sec. 14 BGB) and public authorities based in Germany or Austria. Purchase on invoice requires a successful credit and liquidity check. ROCKSNAKE reserves the right to refuse this payment method in individual cases without giving reasons and to refer the customer to alternative payment methods (e.g. advance payment).
(3) Invoice amounts are due immediately upon invoicing without deduction, unless a different payment term has been agreed.
9. Delivery and Passing of Risk
(1) Consumers (B2C): The risk of accidental loss or deterioration of the goods passes to you only upon handover of the goods to you.
(2) Businesses (B2B): The risk passes to the business upon handover of the goods to the carrier (freight forwarder, parcel service) ex warehouse. Businesses must inspect the goods for transport damage immediately upon receipt and notify defects in writing without undue delay (Sec. 377 German Commercial Code, HGB).
10. Retention of Title
The delivered goods remain the property of ROCKSNAKE GmbH until full payment has been made.
11. Warranty (Liability for Defects)
(1) For consumers: The statutory warranty rights apply (2 years from delivery).
(2) For businesses: The warranty period for newly manufactured goods is 1 year from delivery. In the case of defects, ROCKSNAKE reserves the right to repair or replace. Natural wear and tear (e.g. wear of fabric, rechargeable batteries or batteries) does not constitute a material defect.
(3) Notice of the European Union on the statutory warranty:

12. Medical Device Law and Safety
Where products are subject to the provisions of the EU Medical Device Regulation (MDR / EU 2017/745), the German Medical Devices Implementation Act (MPDG) or the German Medical Devices Operator Ordinance (MPBetreibV), they may only be put into service by appropriately trained personnel. Instruction required by law is not included in the purchase price unless expressly agreed.
13. Batteries and Electrical Equipment (BattDG / ElektroG)
Where we supply batteries or electrical and electronic equipment, the following applies: Used batteries and old appliances do not belong in household waste. Consumers are legally obliged to dispose of them separately from household waste, e.g. via municipal collection points or take-back by retailers. The symbol of the crossed-out wheeled bin indicates this. Batteries containing pollutants additionally bear the chemical symbol of the heavy metal contained (Cd for cadmium, Hg for mercury, Pb for lead).
14. Governing Law and Jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of their home country is not withdrawn.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is the registered office of ROCKSNAKE GmbH.
(3) Consumer dispute resolution: We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
